Contact Between Ekstra Tourism & Travel and ______________
This contract is between Melek TUGRU (representing Ekstra Tourism & Travel Co. located at
Istiklal Cad. 19 Urgup 50400, Nevsehir, Turkey), hereinafter referred to as the
Group Receiver and ____________________________________________
(representing _______________________________________________ located at
_____________________________ ), hereinafter referred to as the Group Provider.
1. Contract Period
This agreement starts on (day / month / year) _____ / _____ / 200___ and will last at most 12 months or end on 31 October; whichever period is shortest.
2. Procedures and Services
a) Reservation details and necessary information must be emailed or faxed to the Group Receiver. The Group Receiver will confirm reservations within two (2) business days if sufficient funds have been received.
b) Reservations can be guaranteed if:
1. The Group Receiver receives the necessary information for tours and/or Blue Cruises at least sixty (60) days prior to arrival, and
2. At least 50% of the total cost has been received according to Ekstra Tourism & Travel's Payment Procedures.
c)The Group Receiver can try to make reservations up to seven (7) days prior to arrival if sufficient funds have been received but the reservations cannot be automatically guaranteed. If sufficient funds have been received and the Group Receiver can make a reservation(s) then a confirmation(s) will be emailed to the Group Provider, otherwise an email will be sent explaining the current situation with suggestions (if any).
d)Upon arrival the Group Provider will look for the Group Receiver's representative who will hold a sign with Ekstra Tourism & Travel's logo. At this time the Group Provider must give the Group Receiver's representative the final payment (if any but never more than 10%) for services booked.
e)Price quotes assume that no more than 25% of the group members will stay in single rooms. If more than 25% of the group members will be in single rooms, than a supplementary charge may be added for each additional single room.
3. Free Room, Tour and Service Policy
a) Ekstra Tourism & Travel will provide a room, tour program(s) and services free of charge for one or more group members according to the group size if there are:
- 21-41 paying group members, then one additional person can be with the group. The one additional person will stay in a double room. If not, then a single room supplement must be paid for.
- 42-61 paying group members, then two additional persons can be with the group. The two additional persons will stay in a double room. If not, then a single room supplement(s) must be paid for.
- 62-81 paying group members, then three additional persons can be with the group. The three additional persons will stay in double rooms. If not, then a single room supplement(s) must be paid for.
- And so on.
b)Only those services specifically included in the group's itinerary will be free. Services and meals to be paid by group members during their visit will also be paid by those included in the above policy.
c)Flight costs inside or outside of Turkey are not included in the above policy.
d)If the Group Provider can not send as many people as originally planned, then the final price quote will be adjusted according to the actual number of group members.
4.Payment Schedule and Options
e) Reservations for the group will be made only when 50% of the total has been received.
f) The remaining 50% can be paid according to any one of the following schedules:
1. 40% of the total to be paid 30 days before the scheduled arrival date.
10% of the total to be paid upon arriving at the airport.
2. 25% of the total to be paid 45 days before the scheduled arrival date.
25% of the total to be paid 30 days before the scheduled arrival date.
3. 20% of the total to be paid 45 days before the scheduled arrival date.
20% of the total to be paid 30 days before the scheduled arrival date.
10% of the total to be paid 15 days before the scheduled arrival date.
g) Payment, according to Ekstra Tourism & Travel's Payment Procedures, can be done by credit card (Visa or MasterCard), bank transfer in US dollars or bank cheque/draft in US dollars.
5. Changes and Cancellations
a) No change or cancellation will be valid until the Group Receiver emails a confirmation that stating that news of a change or cancellation was received.
b) There will be no penalty fees for changes or cancellations made up to thirty (30) days prior to a scheduled arrival date.
c) Penalty fees for schedule changes or cancellations are as follows:
- 25% of the total will be charged if 16 - 30 days prior to the scheduled arrival.
- 50% of the total will be charged if 8 - 15 days prior to the scheduled arrival.
- 100% of the total will be charged if 0 - 7 days prior to the scheduled arrival.
d) The above penalty fees apply only to Blue Cruises and tour programs (which include hotels, guide, breakfasts and dinners). The penalty fees do not apply to restaurants reserved for lunches or for scheduled transfers between the hotel and airport.
Each complaint must be addressed to the Group Receiver by telephone and in writing during the contract period. The Group Receiver guarantees he will do his utmost best to solve the complaint as soon as possible. Complaints addressed to the Group Receiver after the group has left Turkey will not be accepted.
The Group Receiver cannot accept responsibility for faults committed by contracted collaborators such as hotels, bus companies, guides and restaurants nor for consequences resulting from the enforcement of new government regulations.
8. Force Majeure
a) All events beyond the Group Receiver's control are considered as force majeure. Events such as earthquake, flood, union action, epidemic, terrorism or war may prevent the Group Receiver from providing some services.
b) The Group Receiver will not be held responsible in the event of force majeure, but will be obliged to notify the Group Provider as soon as possible by fax or email and later by registered mail. Notification will be supported by official documents and/or newspaper reports.
c) The Group Receiver will also do his utmost to assist the group, assure its safety and if necessary ensure the return to its home country.
d) If an event of force majeure occurs, either party can terminate this contract once all outstanding accounts are settled. Account settlement can be done by email or fax. The Group Receiver will send notification of the contract's termination by registered mail.
a) Baggage is at the owner's risk throughout the visit.
b) It is recommended that group members purchase travel insurance.
10. Settlement of Disagreements
If, after signing this contract, there is a disagreement, it will be submitted to the Court of Justice of Istanbul, which will have sole power to settle the disagreement. The decision(s) made by the Court of Justice of Istanbul will be considered final.
This contract has three (3) pages and ten (10) conditions and has been made in duplicate. By initialing each page, each party confirms he fully understands the contents of that page. This contract is considered valid once both parties have signed and dated it.
